La 33 edición de la Copa del América ha visto la luz tras la sentencia conocida del Tribunal Superior de Nueva York, casi ocho meses después de que el 20 de julio de 2007 el BMW-Oracle presentara una demanda para invalidar el Protocolo y al Club Náutico Español de Vela (CNEV) como 'Challenger of record' (COR).

The 33 edition of the America's Cup has seen the light after the High Court ruling known in New York, almost eight months after the July 20, 2007 BMW-Oracle submitted a demand to invalidate the Protocol and the Yacht Club Spanish Sailing (CNEV) as a 'challenger of record' (COR).

El juez Herman Cahn dictaminó que desestimaba las argumentaciones del Alinghi en su alegación y confirmaba la sentencia del pasado 27 de noviembre que fallaba a favor del BMW-Oracle al considerar inválido al CNEV y por tanto, el Protocolo que firmó con Alinghi para la 33 edición. Además, señalaba que el sindicato estadounidense pasaba a ser el nuevo COR.

Judge Herman Cahn ruled that rejecting the arguments of Alinghi in its claim and confirmed the sentence on 27 November that failed in favour of the BMW-Oracle to consider the CNEV invalid and therefore, the Protocol signed with Alinghi for the 33rd edition . In addition, he noted that the American union became the new COR.
